Terms of Use
Effective November 4, 2026
Cadence is made by Warm Valley Games, LLC ("we," "us"). These terms apply when you use the Cadence app or this website. By using either, you agree to them. If you don't agree, please don't use Cadence.
These terms add to Apple's Licensed Application End User License Agreement, which also applies to apps from the App Store. You must be at least 13 to use Cadence.
Your license
We give you a personal, non-transferable license to use Cadence on Apple devices you own or control, as the App Store allows. You may not copy, modify, reverse engineer, resell, or redistribute the app, except where the law says you can.
Purchases
If Cadence offers paid features, Apple handles the payment through your Apple Account. Refunds follow Apple's policies. Request them from Apple at reportaproblem.apple.com. Any subscription renews on its own until you cancel it in your Apple Account settings at least 24 hours before it renews.
Your content
Everything you put in Cadence is yours, including sheet music, notes, annotations, and recordings. We don't get a copy, and we don't claim any rights to it.
You're responsible for having the right to use what you import. Only add sheet music and other files you own or are allowed to use.
Your data
Your data lives on your devices, and in your private iCloud if you turn on sync. We can't see it, recover it, or restore it for you. Please keep your own backups. Our Privacy Policy explains this in more detail.
Using Cadence fairly
Don't use Cadence to break the law, to infringe someone else's copyright, or to interfere with the app or this website.
Our rights
Cadence, its name, its icon, its design, and its built-in content belong to us. These terms don't give you any rights to them beyond using the app.
Changes to the app
We may change, add, or remove features, or stop offering Cadence, at any time. If we stop offering it, the copy on your device will keep working as long as your device supports it, but we can't promise updates.
No warranty
Cadence is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise the app will be error-free or that your data will never be lost.
Limit of liability
To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or lost time, arising from your use of Cadence. Our total liability for any claim related to Cadence is limited to the amount you paid us for the app in the 12 months before the claim, or $50, whichever is more. Some states don't allow some of these limits, so they may not all apply to you.
Indemnity
If someone brings a claim against us because of content you added to Cadence or because you broke these terms, you agree to cover our reasonable costs from that claim, including attorney's fees.
Ending these terms
You can stop using Cadence at any time by deleting it. If you break these terms, your license ends. The sections on our rights, no warranty, limit of liability, indemnity, and governing law still apply after that.
Governing law
These terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict of law rules. Any dispute about Cadence or these terms will be handled only in the state or federal courts located in Travis County, Texas, and you and we both agree to those courts' jurisdiction.
Any claim about Cadence must be filed within one year after it arises, unless the law requires a longer period.
Everything else
These terms and the Privacy Policy are the whole agreement between you and us about Cadence. If a court finds part of these terms can't be enforced, the rest still applies. If we don't enforce part of these terms right away, we haven't given up the right to enforce it later. You can't transfer these terms to anyone else. We can, for example if Cadence is sold.
If we change these terms, we'll post the new version here and update the date at the top. If you keep using Cadence after that, you accept the new terms.
